Officers returned within 15 minutes and placed her in custody. Testimony was that she said she was the person named on the box but there was no audio or video of this exchange. Further, she was said to have acknowledged knowledge of the contents of the box (over 5 pounds of marijuana). After a jury trial client was found NOT GUILTY.
An informant notified officers that a large amount of marijuana was going to arrive at an individual’s home and that it was to be delivered from out of state. Surveillance was set up and two SUVs arrived, in tandem, to the home under surveillance. Trial testimony was that the officer observed client carry two large duffel bags into the house, but the arrest report left this important item out. There was no audio or video recordings available. The two duffel bags were retrieved as well as over 26 pounds of marijuana. Client’s automobile had drugs and a gun. One of the SUVs had approximately $23,000 in it. After a jury trial, client was found NOT GUILTY.
